Responsibilities
Service Delivery & Installation
When you subscribe to Exicube App Solutions (OPC) Private Limited services, our standard target for setup, installation, and white-labelling services is 15 working days (excluding weekends and public holidays). This timeline assumes timely delivery of all prerequisites by the client and excludes third-party app store review times.
Client Responsibilities
To ensure a smooth setup, you must provide all required access and information, including but not limited to app store credentials, payment gateway keys, and other necessary resources.
Refund Policy
Statutory Rights
Nothing in this Refund Policy affects your statutory cancellation or cooling-off rights under applicable consumer protection laws, including the EU Consumer Rights Directive (14-day cooling-off period for digital services) or the Australian Consumer Law. If your statutory rights provide a more favourable refund or cancellation entitlement, those rights prevail over the terms below.
Subscription Fees
Monthly subscription fees for managed services are billed in advance and are non-refundable. Failure to pay may result in suspension or termination of the service.
Annual Commitment Plans
Annual commitment plans are billed upfront for the full 12-month term. Annual plans are non-refundable upon early cancellation, except where statutory cooling-off rights apply (see Statutory Rights above). If you cancel an annual plan before the term expires, managed services continue until the end of the pre-paid term, after which all services cease. No partial refunds or pro-rata credits are provided for unused months.
Setup Fee Refunds
- A refund on the setup fee is applicable if a refund request is made within 72 hours from the day and time of the payment.
- No refunds will be provided after 72 hours because our team will already have spent significant time on the project setup.
Failed Service Delivery
- If Exicube App Solutions (OPC) Private Limited fails to complete the setup and installation within 15 working days due to its own limitations, a full refund can be requested within the next 15 days of the expected completion date. No refunds will be issued after 30 days from the initial payment.
- It will not be classified as Failed Service Delivery if client fails to deliver the prerequisites for setup and delivery of the service within the first 7 days from the initial payment date. In this case there will be no refunds and Exicube App Solutions (OPC) Private Limited will have the rights to cancel the project.
- App Store Delays: Delays caused by third-party app store review processes (e.g., Apple or Google) or rejections based on their internal guidelines are entirely out of our control and do not constitute a Failed Service Delivery. Refunds will not be granted for third-party review delays.
Additional Customizations
Payments made for any custom development, integrations, or alterations are non-refundable. Customization requests will be assessed separately and do not fall under this refund policy.
Cancellation Policy
Client-Initiated Cancellation
- You may cancel your subscription at any time by sending a written notice to [email protected]. Cancellation takes effect at the end of the current billing cycle.
- Any outstanding fees will still apply upon cancellation.
Exicube App Solutions (OPC) Private Limited Initiated Cancellation
- Exicube App Solutions (OPC) Private Limited may terminate the service due to non-payment, violation of policies, security concerns, unauthorised access, or breach of terms.
- In such cases, no refunds will be issued.
Terms & Updates
Subscription Validity
Continued access to any separate support plans or other subscription based services will require an active and valid subscription. All services, including but not limited to support and maintenance, will be discontinued upon expiry or non-payment.
Policy Updates
Exicube App Solutions (OPC) Private Limited reserves the right to update this policy at any time. We will notify you of material changes via email at least 30 days before they take effect. The latest version will always be available on our website. Continued use of the services constitutes acceptance of the updated terms.
Legal Jurisdiction
This policy and any disputes arising from it are governed by Indian law and subject to the dispute resolution mechanism described in our Terms and Conditions.
